What are Delaware’s sexual harassment prevention training requirements?   

Delaware’s sexual harassment prevention training laws require that all employers in Delaware with 50 or more employees in Delaware provide the training within 1 year of hire. The law requires that employees are trained upon hire and then every two years thereafter.  

What must sexual harassment prevention training in Delaware cover? 

Sexual harassment prevention courses must be interactive and designed to educate employees regarding the prevention of sexual harassment. For non-supervisory staff, harassment training must cover the illegality and definition of sexual harassment using relevant examples, the legal remedies and complaint process available, directions on how to contact the Delaware Department of Labor, and the prohibition against retaliation. For supervisors, sexual harassment prevention training must additionally include the specific responsibilities of a supervisor regarding the prevention and correction of harassment.

Who does Delaware’s sexual harassment prevention training law apply to?  

The state of  Delaware sexual harassment prevention training law requires all public and private sector employers with 50 more employees in the state to provide the training. Employers must train all full-time employees, part-time employees, joint employees, interns, and apprentices. New hires don’t need to be trained until they have been employed for six months.
